Please read carefully. By creating a Koolyum account or using our services, you agree to these Terms of Service. If you do not agree, do not use our services.
Koolyum LLC ("Koolyum", "we", "us") provides an AI-powered phone ordering platform that allows restaurants to use an AI voice agent ("Sara") to answer customer calls and accept food orders 24 hours a day, 7 days a week. These Terms govern your use of our platform, website, and all related services.
You must be at least 18 years old and have the legal authority to enter into contracts on behalf of your restaurant or business to use our services. By creating an account, you represent and warrant that you meet these requirements.
You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@koolyum.com if you suspect unauthorized access to your account.
4.1 Free Trial
All plans include a 30-day free trial. No credit card is required to start your trial. At the end of the trial, your chosen plan billing begins automatically if you have added a payment method.
4.2 Plan Pricing
Starter: $99/month. Growth: $199/month. Pro: $399/month. Prices are in USD and subject to change with 30 days notice.
4.3 Cancellation
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months.
4.4 Late Payment
If payment fails, we will retry for 7 days. If payment remains unsuccessful, your account will be suspended until payment is received.
This section is legally required and non-negotiable.
By using Koolyum, you acknowledge and agree that:
5.1 Our AI agent Sara will identify itself as an AI at the start of every phone call, as required by FCC regulations and the Telephone Consumer Protection Act (TCPA).
5.2 You, as the restaurant owner, are responsible for ensuring that your call forwarding setup complies with all applicable federal, state, and local laws.
5.3 You have the legal right and authority to forward your business phone number to our system.
5.4 You will not use Koolyum to engage in any deceptive practices, including using our AI to impersonate a human without disclosure.
5.5 Koolyum is not liable for any regulatory violations resulting from your failure to comply with applicable telecommunications laws.
You agree NOT to use Koolyum to: violate any applicable law or regulation, transmit spam or unsolicited communications, interfere with or disrupt our services or servers, attempt to gain unauthorized access to our systems, use our platform for any fraudulent purpose, or resell or sublicense our services without written permission.
You retain ownership of your restaurant data, menu items, and customer order information. By using our services, you grant Koolyum a limited license to process this data solely to provide the services described in these Terms. We will not sell your data or use it for purposes other than operating the platform.
We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance during off-peak hours. We are not liable for losses resulting from service interruptions, including missed orders or calls. For critical restaurant operations, maintain a backup ordering method.
You acknowledge that Sara is an AI system with inherent limitations. Sara may occasionally misunderstand orders, fail to respond correctly, or experience technical issues. You are responsible for reviewing orders placed through the system before preparing them. Koolyum is not liable for order errors resulting from AI misinterpretation or customer miscommunication.
The Koolyum platform, Sara AI system, branding, and all related technology are owned exclusively by Koolyum LLC. You may not copy, modify, distribute, or reverse engineer any part of our system. Your restaurant name, menu, and business data remain your intellectual property.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Koolyum shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
You agree to indemnify and hold harmless Koolyum LLC, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
Either party may terminate this agreement at any time. Koolyum may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay. Upon termination, your data will be retained for 90 days and then permanently deleted, unless required by law to retain longer.
These Terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes shall be resolved by binding arbitration in Fairfax County, Virginia, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits against Koolyum.
We may update these Terms from time to time. We will notify you by email and display a notice on the platform at least 14 days before material changes take effect. Your continued use of the services after the effective date constitutes acceptance of the updated Terms.
